A further supplemental agreement to the Headquarters Agreement
Supplemental Agreement pursuant to Section 4(b) of the Agreement between the Republic of Austria and the International Atomic Energy Agency regarding the Headquarters of the International Atomic Energy Agency
The Secretariat of the International Atomic Energy Agency presents its compliments to the Federal Ministry of Foreign Affairs of the Republic of Austria and has the honour to refer to Section 4(b) of the Agreement between the Republic of Austria and the International Atomic Energy Agency regarding the Headquarters of the International Atomic Energy Agency, dated 11 December 1957. Section 4(b) of the Headquarters Agreement provides that
"The IAEA may establish and operate such additional radio and other telecommunication facilities as may be specified by supplemental agreement between the IAEA and the appropriate Austrian authorities."The Secretariat desires to demonstrate at the Austria Centre Vienna, in conjunction with its General Conference, a very small aperture terminal (VSAT) satellite system. The terminal will be operated during the week prior to the General Conference beginning 11 September 1995 for testing purposes and during the General Conference from 18 to 23 September for the demonstration.
The Secretariat also desires to conduct a longer-term demonstration of an international verification concept, based on a VSAT network. The VSAT system which is the same system used for the aforementioned Conference demonstration, will be relocated to a position at the Headquarters Area and will be operated from October 1995 until January 1996.
The Agency will ensure that:
The Agency would be grateful if the competent Austrian Authorities could agree to the establishment and operation of the equipment referred to above and has the honour to propose that this proposal, together with the Ministry's note of reply, shall constitute a supplemental agreement pursuant to Section 4(b) of the Headquarters Agreement. The Agency has the honour to propose further that this supplemental agreement shall have effect as of the date of the Ministry's note of reply.
The Secretariat of the International Atomic Energy Agency avails itself of this opportunity to renew to the Federal Ministry of Foreign Affairs of the Republic of Austria the assurances of its highest consideration.

The Federal Ministry of Foreign Affairs presents its compliments to the IAEA and has the honour to refer to the IAEA's Note Verbale 250-N1.41 of 6 July 1995 and to advise that it has no objection to the installation and operation of a VSAT satellite earth station by the IAEA in Vienna between 11 and 23 September 1995 at the Austria Center Vienna, and thereafter until January 1996 at the Vienna International Centre (IAEA Headquarters), provided that the conditions mentioned in the above Note Verbale, paras (a) - (f), and the technical specifications set forth below are satisfied.

It shall be noted that possible interferences with the operation of the VSAT station in question from ground-based transmission systems cannot be ruled out.
The Federal Ministry of Foreign Affairs has the honour, on behalf of the Austrian Federal Government, to give its consent to the installation and operation of the system described in Note Verbale 250-N1.41 of 6 July 1995 and to confirm that that Note Verbale and this Note of Reply together constitute a supplemental agreement, as provided for in Section 4 (b) of the Agreement dated 11 December 1957 between the Republic of Austria and the IAEA regarding the Headquarters of the IAEA, which takes effect from today.
The Federal Ministry of Foreign Affairs takes this opportunity of reiterating to the IAEA the assurances of its highest esteem.
